Welcome to Whispra, a digital journaling and wellness assistant operated by Nexify Labs LLC (“we,” “our,” or “us”).

By using Whispra (the “App”), you agree to these Terms of Service (“Terms”). Please read them carefully.

1. ✅ Acceptance of Terms

By accessing or using Whispra, you agree to comply with and be bound by these Terms. If you do not agree, please do not use the App.

2. 👤 Eligibility

You must be at least 18 years old to use Whispra. By using the App, you represent that you meet this requirement.

3. 📲 App Description

Whispra offers voice and text journaling, mood tracking, emotional insights, and personalized summaries using AI technology. The App is intended as a self-help and reflection tool — not a substitute for professional mental health services.

4. 🔐 Privacy

Your use of Whispra is also governed by our Privacy Policy. Please review it to understand how we collect, store, and use your information.

5. ✍️ User Content and Ownership

• You retain full ownership of any content you submit, including journal entries, mood check-ins, and responses.
• By using the app, you grant us a limited license to store, process, and display your content to you for the purposes of providing the service.
• We may use aggregated, anonymized data (not linked to any individual) to improve the App and develop insights.

6. 🤖 Use of AI & Third-Party Services

Whispra integrates third-party services (e.g., OpenAI, analytics tools) to enhance your experience. These providers may process your input under secure, controlled agreements. By using the App, you acknowledge and accept this.

7. 🚫 Acceptable Use

• Do not use the App for unlawful or harmful purposes
• Do not harass or impersonate others
• Do not reverse-engineer or scrape the platform
• Do not attempt to access another user’s data
• Do not abuse the AI system or overload the service

Violation may result in immediate suspension or termination of your account.

Disclaimer: The App is intended for general well-being and self-reflection only. Whispra is not a healthcare provider and does not provide medical or psychological diagnosis or treatment. If you are experiencing emotional distress or a mental health emergency, please contact a licensed professional or emergency services.

9. 📴 Account Termination

We may terminate or suspend access to your account at our sole discretion, including for violations of these Terms or misuse of the App. You may delete your account at any time. Upon deletion, we will remove your stored personal data, subject to backup and compliance requirements.

10. 🔁 Modifications to the Service or Terms

We reserve the right to modify or discontinue any part of the App at any time. These Terms may also change. Continued use of the App means you accept any updated Terms.

11. ⚖️ Governing Law

These Terms are governed by the laws of the Commonwealth of Virginia, USA, without regard to conflict-of-law principles.
